Body of the report:
With reference to Current Report No. 93/2025 on commencement of preparations for the JSW business restructuring process and Current Reports No. 12/2021 and 13/2021 on extension of employment guarantees until 2031, the Management Board of Jastrzębska Spółka Węglowa S.A. ["JSW", "Company"] hereby reports that due to the difficult situation of the Company, on 17 November 2025, the JSW Management Board executed an annex to the Collective Agreement of 31 March 2021 ["Annex”] with the Representative Trade Union Organizations operating at JSW.
Under the Annex, it was agreed that the employment guarantees would not cover the following:
employees employed in the Management Board Office and the Production Support Unit, as well as mine employees employed in white collar positions on the surface (with the exception of those employed in the Coal Preparation Department and supervisors on the surface),
employees with pension entitlements,
employees who regularly disrupt the organization of work. Any decision to terminate an employee's employment contract for the above reason should be preceded by an analysis conducted with the participation of representatives of the parties to the Agreement.
