Body of the report:

With reference to Current Report No. 56/2024, the Management Board of Jastrzębska Spółka Węglowa S.A. [“JSW”, “Company”] hereby reports that it was notified on 5 December 2025 of the pronouncement, on the same day, by the Regional Court in Gliwice, 10th Commercial Division [“Regional Court”] of a judgment in the said case [file ref. no. X GC 498/24] whereby the Regional Court declared invalid the resolutions of the Extraordinary Shareholder Meeting on the repeal of resolutions on granting a discharge to the following former Members of the Company’s Management Board on the performance of their duties in 2023:

Mr. Tomasz Cudny,
Mr. Robert Ostrowski,
Mr. Edward Paździorko.

The judgment is not final non-appealable.
