Body of the report: 

With reference to Current Reports No. 20/2023, 12/2025 and 58/2025 regarding the filing of a lawsuit to repeal Resolution No. 7 of the Ordinary Shareholder Meeting of 16 June 2023 regarding the distribution of JSW’s net profit for the financial year ended 31 December 2022, the Management Board of Jastrzębska Spółka Węglowa S.A. [“JSW,” “Company”] hereby reports that on 9 September 2026 it was informed of the announcement on the same day by the Court of Appeals in Katowice of its judgment in the case in question [case file no.: V Aga 143/25]. The Court of Appeals in Katowice dismissed the shareholder's lawsuit. This decision is final.
