Body of the report: 

In reference to current reports no. 7/2026 and 33/2026 the Management Board of Jastrzębska Spółka Węglowa S.A. [“JSW”, “Company”] reports that on 22 May 2026 an agreement was executed by and between JSW and the Ministry of Energy, which constitutes a part of transforming the hard coal mining sector. This agreement provides the employees of the Company who make the decision to stop working definitively in the hard coal mining sector with an opportunity to benefit from non-recurring cash severance payments. 

In connection with the executed agreement, the value of the estimated impact stemming from the memorandum of agreement executed with the Representative Trade Union Organizations referred to in current report no. 7/2026, will diminish in 2026 and 2027 due to the expected downsizing in comparison with its headcount as of 1 February 2026 as a result of implementing safety net measures. The Company will report the final value of the impact exerted by the memorandum of agreement with the Representative Trade Union Organizations on JSW’s operations by following the pertinent procedure applicable to public companies.
