The loan is a key element in the implementation of the February 2026 Implementation Memorandums of Agreement and has been made possible thanks to an amendment to the Act on the System of Development Institutions, introduced by Silesian members of parliament and drafted by the Ministry of State Assets in cooperation with the Ministry of Energy. In practice, this means establishing a financing mechanism for entities whose destabilization could have significant economic and social consequences.
