Material disputes initiated by the social side and relations with the social side

  • JSW KOKS

    There are 10 trade union organizations operating in the company. In 2017 the Management Board of JSW KOKS held talks with trade unions on remuneration policy for 2017 and talks and consultation on changes of the organizational chart iin connection with the establishing of branches in JSW KOKS, as well as on concluding Company-Level Collective Bargaining Agreements for employees of: JSW KOKS with its registered office in Zabrze, the so-called Headquarters of the Company Spółki, JSW KOKS KKZ with its registered office in Radlin, JSW KOKS Przyjaźń with its registered office in Dąbrowa Górnicza. As regards the establishment and validity of Company-Level Collective Bargaining Agreements, the discussions were conducted in compliance with the applicable procedures arising from the applicable provisions of law and from internal sources of labor law. On 28 March 2017, a joint letter from the President of the JSW KOKS Management Board and the Director of the Przyjaźń Branch was sent to the trade unions regarding negotiations on the Company-Level Collective Bargaining Agreements and the presentation of drafts of Labor and Remuneration Bylaws for employees of JSW KOKS with its registered office in Zabrze, employees of JSW KOKS Przyjaźń Branch with its registered office in Dąbrowa Górnicza and employees of JSW KOKS KKS Branch with its registered office in Radlin. The company’s Management Board provided the social partners on an ongoing basis with written information pertaining to employment and remuneration and information pertaining to the company’s current economic standing. During the meetings, which were held on a regular basis, the trade union organizations were kept informed of the company’s financial, social and commercial standing. Moreover, the company’s Management Board and the social partners made arrangements to execute the following documents: agreement on not preparing vacation plans for 2017, agreement on not indexing allowances for shift work and allowances for work under a shift-based or equivalent system, agreement on determination of certain elements of remuneration policy for 2017, agreement on the rules for awarding and issuing food coupons. At the same time, Labor and Remuneration Bylaws for employees of JSW KOKS S.A. in Zabrze, Labor and Remuneration Bylaws for employees of JSW KOKS S.A. Przyjaźń Branch in Dąbrowa Górnicza, and Labor and Remuneration Bylaws for employees of JSW KOKS S.A. KKZ Branch in Radlin were determined and communicated to the employees.

  • JZR

    There are 5 trade union organizations operating in the company. The Joint Trade Union Representation formed on 24 April 2017 entered into a dispute with the Employer on 11 May 2017. This dispute entailed the following demands: raising the average salary by 3% in vocational groups compared to 2016, net of the funds for the quarterly bonus that was suspended in 2016 and unsuspended in 2017 and the 14th salary paid this year in a monthly settlement, adjusting the classification of 10% of the employees, payment of a gross non-recurring bonus of PLN 1,500 per employee. The employer entered into negotiations to solve the dispute through an agreement. During these negotiations the trade unions verified their original postulate and proposed a 2.5% hike in the personal classification rates while simultaneously withdrawing from the non-recurring bonus.

    On 19 May 2017 wage agreement was signed putting an end to the collective dispute. It was agreed: to increase the base wage tables by 2.5% effective as of 1 June 2017, assuming that the rates would be rounded mathematically to full zlotys at general rules, reclassification effective as of 1 June 2017 for 13% employees employed for undetermined period, especially in the groups with the lowest wages and with the required occupational qualifications, and to continue the hitherto possibility of reclassification upon concluding of successive agreements (applicable to employees employed under term agreements), it was decided not to pay the one-off bonus and at the same time it was agreed to resume talks on the matter after closing of Q3 2017. In addition, it was agreed with effect as of 1 January 2017 that the number of persons eligible to receive a quarterly bonus linked to work productivity paid in the amount of PLN 200 to every eligible employee is to be extended to include persons who utilize the two days off work as provided for by the Labor Code to care for a healthy child, both in terms of taking some hours off as well as taking an entire day off.

  • JSK

    As at 31 December 2017, 12 JSK employees were members of the of Inter-Company Organization NSZZ „Solidarność” of Koksownia Przyjaźń in Dąbrowa Górnicza and 2 employees are members of the Trade Union of Continuous Traffic Workers at Wałbrzyskie Zakłady Koksownicze Victoria S.A. In 2017 there were two meetings with trade unions. During the first meeting on 16 January 2017 the following were discussed and agreed: the Bylaws of the Company Social Benefit Fund (reduction of expenses for co-funding of cultural and educational meetings and of sports and recreational events to the amount of PLN 25,000.00 and an increase in co-funding to the self-organized holidays by of the amount of PLN 150.00) and preliminary plan of expenses for 2017. Moreover, employees were paid a discretionary bonus of PLN 150.00 net in January 2017. At the second meeting on 7 September 2017 the discussion concerned payment of the performance bonus in JSW and an increase in the amount allocated to the Company Social Benefit Fund of 2017.

  • PGWiR

    There are 4 trade unions operating in the company. On 16 March 2017, a meeting was held between the Management Board and representatives of the trade union organizations during which the trade unions requested an increase in personal classification rates for employees in the lowest category and an increase in all classification categories. The Management Board presented to the trade unions draft proposals for an increase in personal classification rates by 1.5%. On 14 April 2017 the company’s management board received a letter from the Employee Trade Union on a proposal to raise rates by 2%. On 23 June 2017 a letter was delivered to the trade union organizations informing them of the employer’s willingness to increase personal classification rates by 2%. This growth will not cause the planned level of salary costs to be overrun in 2017. On 19 June 2017 the company’s management board received a letter from NSZZ “Solidarność” demanding that rates be raised by at least 6% along with a threat of launching a collective dispute.

  • ZREM-BUD

    There are 6 trade union organizations operating in the company. In 2017 the Management Board and trade union organizations continued to negotiate and work on a new Company-Level Collective Bargaining Agreement. In addition, the Bylaws of the Company Social Benefit Fund was approved in 2017.

  • SPEDKOKS

    There are 8 trade union organizations operating in the company. On 8 February 2017, a Company-Level Collective Bargaining Agreement was executed for SPEDKOKS employees. It came into effect on 1 April 2017 and was entered in the register of Company-Level Collective Bargaining Agreements. On the same date, the previous Company-Level Collective Bargaining Agreement, dated 15 July 2005, was terminated and information on its termination was entered in the register of Company-Level Collective Bargaining Agreements.

  • BTS

    There are 7 trade union organizations operating in the company. On 20 July 2017, all trade union organizations entered into a collective dispute with the employer. The trade unions presented the following demands: guaranteeing an increase in the charge for the Company Social Benefit Fund in 2017 by PLN 2,500.00 per eligible employee, agreeing on the amount of the Easter allowance at PLN 500.00 (in accordance with the provisions of the CCBA), setting the amount of the Transport Worker Day bonus at PLN 1,000.00 per eligible employee and setting the amount of an additional allowance, the so-called Christmas Eve allowance, at PLN 1,000.00 per eligible employee (in accordance with the provisions of the CCBA). The parties to the dispute decided, in accordance with Article 10 of the Act on Resolving Collective Disputes, to conduct further negotiations with the participation of a mediator selected from the Ministry’s list of mediators. The collective dispute was put to an end to an agreement 8 December 2017. It was agreed that the additional amount allocated to the Company Social Benefit Fund as a liability of 2017 would be increased by the amount of PLN 1000 per each eligible employee with payment in December 2017 and an additional payment was agreed in the amount of PLN 2000 per each eligible employee with payment by the end of Q1 2018 as satisfaction of the other claims concerning 2017.

  • JSW SiG

    There are 2 trade union organizations operating in the company. On 18 August 2017 the Company’s Management Board signed with representatives of the trade union organizations operating in the company Annex no. 1/2017 to the Bylaws of the Company Social Benefit Fund introducing new regulations concerning amount ranges for the purposes of determining the amount of benefits granted to employees of JSW SIG. In 2017 as a result of the ended dispute the daily rate for regeneration meals was increased to the amount of PLN 19.
